Protection from Harassment
The Protection from Harassment Act 1997 was introduced by parliament to try and
provide some certainty concerning a difficult and complex area of the law. The Courts have found it difficult to protect individuals in some circumstances, the high profile
cases involving celebrities, where individuals had harassed, stalked or intimidated
individuals. Previously it had been difficult to obtain injunctions in those sorts
of cases. The Protection from Harassment Act changed that.
The Act allows the Police and Crown Prosecution Service to pursue individuals through
the criminal Court where there has been harassment. In less serious cases where
the police are
not prepared to act, we can help by issuing proceedings in the local
County Court for injunctions and damages where appropriate to protect individuals
from harassment and intimidation.
The cases we deal with vary greatly. The cases can range from problems between neighbours
to situations where an individuals has suffered a violent attack and requires an
injunction against their attacker.
The law has recently been extended in relation to these cases so that where an individual
suffers harassment at work (within the meaning of the act) which might include bullying,
sexual, racial or disability discrimination, proceedings can be issued under this
Act.
It is possible, in some cases, to carry these sorts of cases out on a conditional
fee basis and to obtain public funding certificates from the Legal Services Commission.
